Terms of Service

1. Acceptance

By accessing RockScan at rockidentifier.tech, using the web studio at https://rockidentifier.tech/app, or installing the RockScan iPhone app, you agree to these Terms of Service. If you do not agree, do not use the service.

2. What RockScan provides

RockScan offers photo-based suggestions for rocks, minerals, gemstones, crystals, and fossils, plus educational directory content, collection tools, and optional premium features. Results are informational and may include estimated value ranges or authenticity context. They are not professional appraisals, assay reports, or safety certifications.

3. Accounts and sign-in

Web. The web studio requires sign-in via email magic link or Google. You are responsible for securing access to your email account and for activity that occurs while you are signed in.

iPhone. The app may operate with an anonymous device identifier for sync and purchases. You are responsible for your device and App Store account security.

4. Subscriptions and payments

iPhone (RockScan Pro). Unlimited scans, Ask AI, and other premium features may require a subscription or lifetime purchase through Apple’s App Store. Pricing is shown in the app before purchase. Subscriptions renew automatically unless cancelled in your Apple ID settings at least 24 hours before the end of the current period. Refunds follow Apple’s policies.

Web. The web studio may offer free access with sign-in. Paid web plans, when available, are processed by Stripe. Prices and renewal terms are displayed at checkout. You can cancel recurring web subscriptions through the billing portal or by contacting us.

We may change pricing or plan features with notice on the website or in-app. Changes apply to new purchases and renewals as permitted by the applicable store or payment provider.

5. Separate platforms

The website and iPhone app are related products but operate on different account and billing systems. A subscription or purchase on the web does not automatically unlock the iOS app, and an App Store purchase does not automatically unlock the web studio, unless we explicitly state otherwise in the product.

Scan history and collections may not sync between web and iOS accounts today. Each platform stores data according to its own sign-in model described in our Privacy Policy.

6. Acceptable use

You agree not to:

• Use RockScan for unlawful purposes or to misrepresent specimen identity in commerce
• Upload content you do not have the right to share
• Attempt to reverse engineer, scrape, or overload our systems
• Circumvent access limits, paywalls, or rate limits

We may apply fair-use rate limits to protect service quality, including for paid users with atypical usage patterns.

7. Important limitations

Not a substitute for experts. Do not use RockScan as the sole basis for purchasing, selling, insuring, or handling specimens—especially for high-value gems, hazardous minerals, or regulated materials. Verify identifications with qualified professionals and follow local laws for collecting, exporting, or trading geological material.

Values are estimates. Any dollar ranges are educational and market-sensitive. They are not guarantees of resale price or investment return.

Real vs fake guides summarize common field tests and trade tells; they cannot replace laboratory analysis.

8. Your content

You retain ownership of photos you upload. You grant RockScan a limited license to process, store, and display them back to you solely to operate the identification and collection features. We do not claim ownership of your specimen images.

9. Intellectual property

RockScan’s name, branding, website design, directory text, and software are protected by intellectual property laws. You may not copy, modify, or redistribute our content or code except as allowed by law or with written permission.

10. Third-party services

RockScan relies on third parties such as cloud hosts, vision AI providers, email delivery, payment processors, and app-store platforms. We are not responsible for outages, errors, or policy changes caused by those providers, though we work to minimize disruption.

11. Privacy

Your use of RockScan is also governed by our Privacy Policy, which explains what we collect and how we use it.

12. Termination

You may stop using RockScan at any time. We may suspend or terminate access if you violate these Terms, create risk for other users, or if we discontinue the service. Provisions that by nature should survive (disclaimers, limitations of liability) will survive termination.

13. Disclaimer of warranties

RockScan is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that identifications will be accurate, complete, or uninterrupted.

14. Limitation of liability

To the fullest extent permitted by law, RockScan and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising from your use of the service or reliance on any identification, value estimate, or guide content.

Our total liability for any claim relating to RockScan will not exceed the greater of (a) the amount you paid us in the twelve months before the claim or (b) fifty US dollars.

15. Apple-specific terms

If you use the iPhone app, Apple is not a party to these Terms and has no obligation to provide maintenance or support for RockScan. In-app purchases are between you and Apple under Apple’s terms. Apple’s standard Licensed Application End User License Agreement also applies where required by the App Store.

16. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the date above. Your continued use after changes constitutes acceptance.
